RESOLUTION CNSP Nº 380, OF 04.03.2020

Amends Resolution CNSP nº 168, of 17 December 2007.

The SUPERINTENDENCY OF PRIVATE INSURANCE – SUSEP, in exercise of the powers granted by art. 34, item XI, of Decree nº 60.549, of 13 March 1967, and considering the contents of SUSEP file no 15414.622511/2019-19, makes it public that the NATIONAL COUNCIL OF PRIVATE INSURANCE – CNSP, in the ordinary session held on 4 March 2020, according to section I of art. 32, of Decree-Law nº  73, of 21 November 1966, resolved:

Art. 1st To amend the Resolution CNSP nº 168, of 17 December 2007.

Art. 2nd The paragraph 1st of art. 2nd of Resolution CNSP nº 168, of 2007, is amended as follows:

"Paragraph 1st The cooperative society authorized to operate in private insurance, and the open complementary pension entity (EAPC), which contracts reinsurance operations, will be equivalent to a insurance company, provided that the conditions imposed on insurance companies by the CNSP also apply to them. (NR)”.

Art. 3rd A paragraph 3rd is added to art. 2nd of Resolution CNSP nº 168, of 2007, as follows:

"Paragraph 3rd The closed complementary pension entity (EFPC), and the private health plan operator, which contracts reinsurance operations, will be equivalent to a cedent, without prejudice to the duties of the respective regulatory and supervisory body, being the powers of SUSEP affecting the EFPCs and the private health plan operators limited to the supervision of those reinsurance operations. (NR)”.

Art. 4th Art. 44 of Resolution CNSP nº168, of 2007, is amended as follows:

"Art. 44. SUSEP may, at any time, conduct on-site inspections, as well as demand from the open complementary pension entities, insurance companies, local reinsurers, reinsurance brokers and representative offices to provide information and present documents as deemed necessary for the exercise of its controlling and supervisory functions. (NR).”

Art. 5th The following provisions of Resolution CNSP nº168, of 2007, are hereby revoked:

I - paragraphs 1st and 3rd of art. 14 and paragraph 5th of art. 15;

II - the sole paragraph of art. 17; and

III - articles 21 to 26.

Art. 6th This Resolution becomes effective as of 1st April 2020.
