DECREE Nº 10.167, OF 10 DECEMBER 2019
Provides for the upper limit of cession to eventual reinsurers, as mentioned in § 1th of the art. 8th of the Complementary Law nº 126, of 15 January 2007.
THE PRESIDENT OF THE REPUBLIC, in the exercise of the powers granted by the head of art. 84, subsections IV and VI, line “a”, of the Constitution, and considering the established in the art. 8th, § 1th, of the Complementary Law no 126, of 15 January 2007,
Decrees:
Art. 1st – Insurance companies or cooperatives are allowed to cede to eventual reinsurers up to ninety-five percent of the total volume of their premiums ceded in reinsurance, calculated on the basis of their overall operations in each calendar year.
Sole Paragraph – By means of a specific act, the insurance regulatory entity is authorized to except certain insurance branches and forms with a percentage higher than the one set in the head of this article.
Art. 2nd – Local reinsurers are allowed to cede to eventual reinsurers up to ninety-five percent of the total volume of premiums concerning their underwritten risks, calculated on the basis of their overall operations in each calendar year.
Art. 3rd – Decree nº 6.499, of 1st July 2008 is hereby revoked.
Art. 4th – This Decree comes into force on the date of its publication.
